This Telenav1 Privacy Policy ("Policy") governs your use and access to specific products, namely the Appstore Application ("Appstore") developed and integrated within Chery head unit, with or through our affiliates or subsidiaries2 ("Telenav," "we," "us," "our"). By using or accessing our services or products, you acknowledge this Policy and agree to be subject to it. You acknowledge and understand that this Policy does not apply to our business partners, suppliers or other companies that Telenav does not own or operate. For information on how our business partners, suppliers and other companies process your Personal Data (as defined below), please consult their privacy policies when you access their product/service. If you do not agree with the terms of this Policy, please do not use or access our services or our products or engage in any of these activities.
We are committed to protecting and respecting your privacy. This Policy describes our approach to data protection, data privacy and data security, including our compliance with middle east privacy legislation or other various governmental regulations and local requirements3 ("Applicable Data Protection Laws"), and explains why and how we may collect, store, process and distribute your Personal Data to third parties. We also describe in this Policy your rights in relation to your data.
By "Personal Data", we refer to any information through which an individual may be directly or indirectly identified, including name, social security number, numbers, addresses, bank account and credit card details, and pictures.4
Except where stated otherwise in this Policy, Telenav is the controller5 in relation to the Personal Data we may collect, store, process, and distribute in accordance with this Policy, as described herein.
Please refer to Section IX ("Contacting Telenav") for questions and requests you may have relating to this Policy.
We gather various information from our Appstore depending on how you interact with us. We may collect some information directly from you, or we may collect other information indirectly through your use of our Appstore.
Categories of data collected
We collect information through your interaction with and use of our Appstore, which may include, but is not limited to:
Account data: device ID and VIN – used for the Appstore registration and license activation to count the service period;
Electronic activity information and Appstore interaction data: download history, download frequency, usage data, diagnostic data, data collected through automated electronic interactions or statistical and aggregated information ("Other Information"); Note that all data collected under point b) is for statistical purposes and cannot individually identify you and therefore is not considered Personal Data under the Applicable Data Protection Laws.
Purposes of Processing
For the performance of the contractual relationship between the user/customer and Telenav, as defined in the Appstore Terms and Conditions, such as, but not limited to, installing apps, updating apps or any other interaction with the Appstore; further details on the purposes of processing can be found by consulting the Telenav Terms and Conditions, available within the Appstore.
We may collect, store, process, and distribute your Personal Data and Other Information to provide you with our products and services, to process your requests or as otherwise may be necessary to perform the contract between you and Telenav, to ensure the functionality and security of our products and services, and to prevent and investigate fraud and other misuses.
For the fulfillment of Telenav's legal obligations in the context of the services provided through Telenav, including financial, accounting, tax, and archiving obligations;
For the purpose of carrying out various statistical analyses and reports on Appstore usage, mainly for the purpose of improving the products or services offered by Telenav. Telenav may also transmit statistical data to its Partners, but all information thus transmitted to third parties will be provided in an aggregate form without including data that could lead to the identification (directly or indirectly) of the data subjects.
For the resolution of potential complaints, claims, technical issues or any other requests submitted via Appstore and also to improve the products and services offered by Telenav to its users/customers;
For the usage of third-party applications - some of Telenav's products or services provide you with access to third-party applications. When you access and enable a third-party application, Telenav may process information we have collected under our Policy. However, information collected by the third-party application provider is governed by such third-party's terms and conditions and privacy policy.
Legal grounds for Personal Data processing
Telenav processes your data under the Applicable Data Protection Laws. We, therefore, process your data for the purposes described in II.2. and according to the following legal grounds:
Your consent in relation to the processing for which the Applicable Data Protection Laws impose to obtain such permission. To the extent that you have given your consent, and the basis of the processing is your consent, you have the right to withdraw your consent at any time without affecting the lawfulness of the processing carried out by Telenav prior to the withdrawal.
The legal obligations incumbent upon Telenav as a result of the services provided through Telenav;
For the conclusion, respectively the execution of a contract (by accepting the Terms and Conditions) with regard to the usage of the Appstore provided by Telenav;
As a matter of principle, Telenav will process Personal Data for the entire duration of the contractual relationship, and thereafter the Personal Data will be stored for the periods applicable to the various types of Personal Data, established in accordance with Telenav's data and document storage and archiving Policy, respectively for the duration necessary to fulfill the legal obligations incumbent upon Telenav (e.g., in the case of financial-accounting supporting documents).
Also, users' data regarding their usage of the Appstore will be processed until the moment when the data subject requests the deletion of such data, in accordance with the Applicable Data Protection Laws or you object to the processing and there are no overriding legitimate and compelling reasons for processing (e.g. the existence of a legal obligation, the existence of a contractual relationship, Telenav's legitimate interest), Telenav will stop processing your Personal Data. Subsequently, Telenav may anonymize these data, thus depriving them of their personal character, and continue processing the anonymized data in an aggregated manner and only for statistical purposes.
When a customer requests to delete all their data, certain categories of Personal Data may be further processed by Telenav in view of Applicable Data Protection Laws, i.e. based on our legitimate interests (such as defending rights or interests, handling possible claims).
Telenav affiliates and authorized third parties
We may share Personal Data with our affiliates, partners, car-manufacturer, vendors, or agents working on our behalf for the purposes described in this Policy. For example, we may hire companies to assist with protecting and securing our systems or services and to support the purposes described herein. We may share Personal Data with the following categories of recipients: hosting providers, cloud SaaS software providers, technical and support providers, or any other service provider on which the provision or proper functioning of the products or services offered by Telenav depends.
Any vendor or agent we retain must comply with our data privacy and security requirements and this Policy and are not allowed to use Personal Data they receive from us for any other purpose. We remain responsible and liable under Applicable Data Protection Laws if third-party agents we engage to process Personal Data on our behalf do so in a manner inconsistent with the Applicable Data Protection Laws unless we prove that we are not responsible for the event giving rise to the damage.
International transfers of Personal Data
Our Appstore product is provided using resources and servers located in various countries around the world. Therefore, we or our partners, vendors or agents may transfer your Personal Data across international borders outside the country where you use our Appstore, for example, into the United States of America. In such cases, we ensure that, prior to any transfer, there is a legal basis for such a transfer and that adequate protection for your Personal Data is provided as required by applicable law, for example, by using standard contractual clauses approved by the European Commission or relevant authorities (where necessary) and by requiring the use of other appropriate technical and organizational information security measures. You may contact the Telenav privacy team at privacy@telenav.com to obtain additional information about the safeguards we take in connection with these transfers.
Mandatory Disclosures
We will comply with any subpoenas, court orders or other legal processes for any of the information about you in our possession, and we may use such information to establish or exercise your, ours, or others' legal rights or to defend against legal claims. We also may be required to disclose Personal Data in response to a lawful request by public authorities, including to meet national security or law enforcement requirements.
Mergers and Acquisitions
If we decide to sell, buy, merge, or otherwise reorganize our businesses in certain countries, this may involve our disclosing Personal Data to prospective or actual purchasers and their advisers, or receiving Personal Data from sellers and their advisers. In case of such disclosures of Personal Data, we will comply with all applicable privacy requirements.
Partners or third-party providers may also process your data on their own behalf, as data controllers to the extent that they will be contacted directly by you regarding their products/services, Telenav has no control over how these partners/third-party providers process your data. Therefore, for the processing activities of your Personal Data carried out by Telenav partners and with whom you enter into a relationship through Appstore, please consult and consider the privacy policies and other relevant policies or terms provided by them.
Under Applicable Data Protection Laws, the provision of Personal Data may be a contractual obligation or an obligation necessary for the conclusion of a contract and is required to provide a product, a service or benefit. Refusal to provide Personal Data may make it impossible for you to benefit from the products and services made available.
We recognize that we have a special obligation to protect personal information obtained from children. We do not intend for children to use our services and products. Therefore, we will not knowingly request or collect personal information from any child or process such information without prior verifiable parental or legal guardian consent. If, however, you authorize a child to use our Appstore, we will understand and treat any Personal Data associated with such use as your information in accordance with this Policy. For the purpose of this Policy, a child means any individual who is under the minimum legal age to consent according to the Applicable Data Protection Laws.
If you have reason to believe that we may have accidentally received information from a child, please get in touch with us immediately at privacy@telenav.com to have the information verified and deleted from our records, except where necessary to protect the safety of the child or others as required by Applicable Data Protection Laws.
Your privacy is important to us, and we maintain reasonable and appropriate security procedures to protect your information from loss, misuse and unauthorized access, disclosure, alteration and destruction, taking into account the risks involved in the processing and the nature of the Personal Data. For instance, Telenav limits access to Telenav systems that store such information to authorized personnel. Telenav also uses the Secure Sockets Layer (SSL) protocol to ensure our transmission of Personal Data is secured through encryption.
While Telenav maintains various security measures to prevent unauthorized access to or disclosure of your Personal Data, no security measures are absolute or wholly guaranteed. We recommend you protect yourself against any unauthorized access to your account by keeping your password and log in credentials confidential.
If required by law, we will notify you if we determine unauthorized acts violate the law, this Policy, or other security breaches.
You have specific statutory rights under the Applicable Data Protection Laws regarding the Personal Data Telenav processes about you. These are briefly explained below, and you can exercise them by using the contact information details under the "Contacting Telenav" section.
The right to know what Personal Data we hold about you and the right to access it. You may obtain confirmation directly from us that we are processing your data, as well as information on the specifics of the processing such as purpose, categories of Personal Data processed, recipients of the data, the period for which the data is kept, the existence of the right of rectification, erasure or restriction of processing by contacting us at privacy@telenav.com.
The right to rectify incomplete and/or incorrect Personal Data concerning you.
The right to delete your Personal Data.
The right to object to or restrict the processing of your Personal Data, in certain circumstances. If you object, and your objection is justified, we will no longer process your Personal Data or we will adjust our processing activities accordingly. On the contrary, if the legitimate reasons described by us as a justification for the processing prevail the reasons you described, we will inform you of why we are entitled to continue processing your Personal Data.
The right to portability, meaning the right to receive the Personal Data you have provided us with and, if technically possible, request that we transfer your Personal Data to another organization, under certain circumstances.
The right to revoke your consent at any time and without giving any reasons where processing your Personal Data is based on your consent. Such withdrawal shall have no impact on the data processing activities that have taken place before the withdrawal or any other further processing activity of your Personal Data, which is justified by an existing legal justification. Please note if you revoke your consent, we may not be able to continue providing certain services to you.
The right not to be subject to any automatic individual decisions that produce legal effects on you or significantly affect you.
In the event that the data subject makes a request for deletion of data, under the conditions provided by the Applicable Data Protection Laws, Telenav may further still process certain Personal Data under (i) legal obligation (e.g. in the case of invoices, financial-accounting, tax and archiving supporting documents) (ii) contract concluded between Telenav and User, including that represented by the Terms and Conditions document; (iii) Telenav's legitimate interest (e.g. in order to deal with requests/complaints that may be received from you or from the competent authorities or to carry out any checks justified by law, including in relation to online fraud or the exercise/enforcement of Telenav's rights in court).

Other Agreements
Telenav may enter into written product or service agreements with customers that contain specific confidentiality, security or other information handling provisions. If this Policy conflicts with any provision of those terms and agreements (both US and international), those terms and agreements govern to the extent of inconsistency. In all other instances, the terms of this Policy apply.
Governing Law
By choosing to access or use our Appstore, you agree that any dispute over privacy or the terms contained in this Policy will be governed by the laws of the State of California, United States of America; provided, however, (i) this Policy shall be governed by the Applicable Data Protection Laws as defined on Section I: or (ii) such other governing law as may be mandated by the jurisdiction in which you reside. Except where prohibited by applicable law (which may include Quebec), you also agree to arbitrate such disputes and to abide by any limitation on damages contained in our Terms of Use, Terms and Conditions of Service, or other applicable agreements we have with you.
Amendments to this Policy
We may, from time to time, make changes to this Policy. We will publish any changes on the relevant platform where our product is used and notify you accordingly. The changes will be effective as of the date of publication.
