Welcome to our Weather Application ("App"). These terms and conditions ("Terms") govern your use of our App, so please read them carefully. By clicking "accept" or by using our App, you agree to these Terms. If you do not accept these terms and conditions, do not launch or use our App.
These terms and conditions represent the Agreement ("Agreement") between you and Telenav Shanghai Inc1. ("Telenav") with respect to our App, including any component thereof. All references herein to "you" and "your" means you, your employees, agents, and contractors, and any other entity on whose behalf you accept these terms and conditions, all of whom shall also be bound by this Agreement. Additionally, your account information, as well as other personal information provided by you to Telenav (directly or through the use of the App), is subject to Weather Privacy Policy. Except where prohibited by applicable law, Telenav may revise this Agreement at any time, with notice to you. Where this Agreement is provided bilingual in English and a local language, and in case there is a conflict between the English version and the local language version, the English version shall prevail.
Use of the App constitutes a declaration of compliance with the following conditions: (I) THE ATTAINMENT OF 18 YEARS OF AGE EXCEPT FOR UAE, QATAR, KUWAIT AND BAHRAIN WHERE THE LEGAL MAJORITY IS 21 (II) THE ABSENCE OF CIRCUMSTANCES AFFECTING LEGAL CAPACITY, (III) IN THE CASE OF PROFESSIONALS, THE FULFILMENT OF ALL LEGAL REQUIREMENTS AND THE POSSESSION OF ALL NECESSARY AUTHORISATIONS TO PROVIDE THE SERVICES OFFERED THROUGH THE APPSTORE, AND (IV) FULL ACCEPTANCE OF AND COMPLIANCE WITH ALL PROVISIONS OF THIS AGREEMENT, INCLUDING THOSE RELATING TO THE LIMITATION OF LIABILITY OF TELENAV AND APPLICABLE LAW. If any of these conditions are not met, the user must immediately cease accessing or using the App.
You acknowledge that devoting attention to the App may pose a risk of injury or death to you and others in situations that otherwise require your undivided attention, and you, therefore, agree to comply with the following when using the App: (a) observe all traffic laws and otherwise drive safely; (b) use your own personal judgment while driving; (c) do not manipulate the App, unless your vehicle is stationary and parked; (d) do not use the App for any illegal, unauthorized, unintended, unsafe, hazardous, or unlawful purposes, or in any manner inconsistent with this Agreement; (e) arrange all GPS and wireless devices and cables necessary for the use of the App in a secure manner in your vehicle so that they will not interfere with your driving and will not prevent the operation of any safety device (such as an airbag).
You agree to indemnify and hold Telenav harmless against all claims resulting from any dangerous or otherwise inappropriate use of the App in any moving vehicle, including because of your failure to comply with the directions above.
The App offered by Telenav allows the user to (i) see the current city weather based on the location; (ii) search for a city weather by taping the city name; (iii) allow the user to add/follow a city weather; (iv) allow user to reorder added city or delete added city; (v) allow user to change unit, see service period etc.
To enable your use of the App, Telenav may receive the VIN, geolocation, and electronic activity information along with interaction data related to your use of the App. Using the App allows Telenav to obtain, use and share such personal data, subject to the Privacy Policy, as provided in the link above.
Subject to your compliance with the terms of this Agreement, Telenav hereby grants you a personal, non-exclusive, non-transferable license, without the right to sublicense, to access and use the App as installed in the vehicle. This license shall terminate upon any termination or expiration of this Agreement. You agree that you will use the App only for personal use, business or leisure purposes and not to provide services to other parties. Unless otherwise outlined in a separate agreement accompanying such third-party materials, this Agreement governs your use of third-party Materials delivered with or accessed by the App.
License Limitations
You agree not to do any of the following: (a) reverse engineer, decompile, disassemble, translate, modify, alter or otherwise change the App or any part thereof; (b) attempt to derive the source code, audio library or structure of the App without the prior express written consent of Telenav; (c) remove from the App, or alter, any of Telenav's or its suppliers' trademarks, trade names, logos, patent or copyright notices, or other notices or markings; (d) distribute, sublicense or otherwise transfer the App to others, except as part of your permanent transfer of the App; or (e) use or access the App in any manner that: (i) infringes the intellectual property or proprietary rights, rights of publicity or privacy or other rights of any party, (ii) violates any law, statute, ordinance or regulation, including but not limited to laws and regulations related to spamming, privacy, consumer and child protection, obscenity or defamation, and all applicable export and re-export control laws and regulations, or (iii) is harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, or otherwise objectionable; and (f) lease, rent out, or otherwise permit unauthorized access by third parties to the App without advanced written permission of Telenav.
While we strive to provide accurate weather information, we cannot guarantee our App's information's accuracy, completeness, timeliness, or reliability. You acknowledge and agree that any reliance on such information is at your own risk.
Except where prohibited by applicable law, in no event will Telenav, its licensors, customers, suppliers, agents or employees of any of the foregoing be liable for any decision made or action taken by you or anyone else in reliance on the information provided by the App. Unless otherwise provided under applicable laws, Telenav and its licensors, customers, and suppliers also do not warrant or condition the accuracy of the data used for the App. Telenav and its licensors, customers and suppliers also do not warrant that your use of the App will be uninterrupted or error-free. Telenav will exercise reasonable efforts to limit or prevent such occurrences, but in no event will Telenav be liable for any financial or other damages due to such interruptions. You are responsible for the entire risk arising from using the App.
EXCEPT WHERE PROHIBITED BY APPLICABLE LAW, TELENAV AND ITS LICENSORS, CUSTOMERS AND SUPPLIERS EXPRESSLY DISCLAIM AND EXCLUDE ALL WARRANTIES OR CONDITIONS IN CONNECTION WITH THE APP, WHETHER STATUTORY, EXPRESS OR IMPLIED, INCLUDING ALL WARRANTIES OR CONDITIONS WHICH MAY ARISE FROM THE COURSE OF DEALING, CUSTOM OR TRADE AND INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT OF THIRD-PARTY RIGHTS WITH RESPECT TO THE APP. CERTAIN JURISDICTIONS DO NOT PERMIT THE DISCLAIMER OF CERTAIN WARRANTIES, SO THIS LIMITATION MAY NOT APPLY TO YOU.
EXCEPT WHERE PROHIBITED BY APPLICABLE LAW, UNDER NO CIRCUMSTANCES SHALL TELENAV AND ITS LICENSORS, CUSTOMERS, AND SUPPLIERS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES (INCLUDING IN EACH CASE, BUT NOT LIMITED TO, DAMAGES FOR THE INABILITY TO USE THE EQUIPMENT OR ACCESS DATA, LOSS OF DATA, LOSS OF BUSINESS, LOSS OF PROFITS, BUSINESS INTERRUPTION OR THE LIKE) ARISING OUT OF THE USE OF OR INABILITY TO USE THE APP, EVEN IF TELENAV HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
EXCEPT WHERE PROHIBITED BY APPLICABLE LAW, NOTWITHSTANDING ANY DAMAGES THAT YOU MIGHT INCUR FOR ANY REASON WHATSOEVER (INCLUDING, WITHOUT LIMITATION, ALL DAMAGES REFERENCED HEREIN AND ALL DIRECT OR GENERAL DAMAGES IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE), THE ENTIRE LIABILITY OF TELENAV AND OF ALL OF TELENAV'S, LICENSORS, CUSTOMERS AND SUPPLIERS SHALL BE LIMITED TO THE AMOUNT ACTUALLY PAID BY YOU FOR THE APP. SOME PROVINCES, STATES, AND OTHER JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU.
OUR APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE USE OR PERFORMANCE OF OUR APP, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
You agree that any dispute, claim, or controversy arising out of or relating to this Agreement or the App shall be finally settled under the Rules of Arbitration of the International Chamber of Commerce by one or more arbitrators appointed in accordance with the said Rules. The seat of the arbitration will be Berlin, Germany, and it will be conducted in the English language. Note that there is no judge or jury in an arbitration proceeding and the decision of the arbitrator shall be binding upon both parties. You expressly agree to waive your right to a jury trial.
This Agreement and performance hereunder will be governed by and construed in accordance with the laws of Germany without giving effect to its conflict of laws provisions. To the extent judicial action is necessary in connection with the binding arbitration, both Telenav and you agree to submit to the exclusive jurisdiction of the courts of Berlin, Germany. The United Nations Convention on Contracts for the International Sale of Goods shall not apply.
You may not resell, assign, or transfer this Agreement or any of your rights or obligations, except in totality, in connection with your permanent transfer of the App, and expressly conditioned upon the new user of the App agreeing to be bound by the terms and conditions of this Agreement. Any such sale, assignment or transfer that is not expressly permitted under this paragraph will result in immediate termination of this Agreement, without liability to Telenav, in which case you and all other parties shall immediately cease all use of the App. Notwithstanding the foregoing, Telenav may assign this Agreement to any other party at any time without notice, provided the assignee remains bound by this Agreement.
This Agreement constitutes the entire Agreement between Telenav and you with respect to the subject matter hereof.
Except for the limited licenses expressly granted in this Agreement, Telenav retains all rights, title, and interest in and to the App, including all related intellectual property rights, without limitation. No licenses or other rights which are not expressly granted in this Agreement are intended to, or shall be, granted or conferred by implication, statute, inducement, estoppel or otherwise, and Telenav and its suppliers and licensors hereby reserve all of their respective rights other than the licenses explicitly granted in this Agreement.
By using the App, you consent to receive from Telenav all communications, including notices, agreements, legally required disclosures or other information in connection with the App (collectively, "Notices") electronically. Telenav may provide such Notices by posting them on Telenav's Website, on the App, or by downloading such Notices to your device. If you desire to withdraw your consent to receive Notices electronically, you must discontinue using the App.
Telenav's or your failure to require performance of any provision shall not affect that party's right to require performance at any time thereafter, nor shall a waiver of any breach or default of this Agreement constitute a waiver of any subsequent breach or default or a waiver of the provision itself.
If any provision herein is held unenforceable, then such provision will be modified to reflect the Parties' intention, and the remaining provisions of this Agreement will remain in full force and effect.
The headings in this Agreement are for convenient reference only, will not be deemed to be a part of this Agreement, and will not be referred to in connection with the construction or interpretation of this Agreement. As used in this Agreement, the words "include" and "including," and variations thereof, will not be deemed to be terms of limitation but instead will be deemed to be followed by the words "without limitation."
The App may utilize software or data licensed to Telenav by third-party vendors to benefit you and other end users. This Agreement includes a reference to the end-user terms applicable to these companies; thus, your use of the App is also subject to such terms. You agree to comply with the following additional terms and conditions applicable to Telenav's third-party vendor licensors. Such terms and conditions can be found below:

يشكل استخدام التطبيق إقرارًا بالامتثال للشروط التالية: (١) بلوغ سن ١٨ عامًا باستثناء الإمارات العربية المتحدة وقطر والكويت والبحرين حيث الغالبية القانونية هي ٢١ (٢) غياب الظروف التي تؤثر على القدرة القانونية، (٣) في حالة المهنيين، استيفاء جميع المتطلبات القانونية وامتلاك جميع التصاريح اللازمة لتقديم الخدمات المقدمة من خلال التطبيق، (٤) القبول الكامل والامتثال لجميع البنود، للحد من مسؤولية TELENAV والقانون المعمول به. في حالة عدم استيفاء أي من هذه الشروط، يجب على المستخدم التوقف فورًا عن الوصول إلى التطبيق أو استخدامه.

توافق على تعويض Telenav وحمايته من جميع المطالبات الناتجة عن أي استخدام خطير أو غير ملائم للتطبيق في أي مركبة متحركة، بما في ذلك بسبب عدم امتثالك للتوجيهات أعلاه.
يتيح التطبيق المقدم من Telenav للمستخدم (1) الاطلاع على طقس المدينة الحالي بناءً على الموقع؛ (2) البحث عن طقس المدينة عن طريق الضغط على اسم المدينة؛ (3) تسمح للمستخدم بإضافة/متابعة طقس المدينة؛ (4) السماح للمستخدم بإعادة ترتيب المدينة المضافة أو حذف المدينة المضافة؛ (5) السماح للمستخدم بتغيير الوحدة، والاطلاع على فترة الخدمة وما إلى ذلك.
لتمكين استخدامك للتطبيق، قد تحصل Telenav على رقم VIN والموقع الجغرافي ومعلومات النشاط الإلكتروني إلى جانب بيانات التفاعل المتعلقة باستخدامك للتطبيق. يسمح استخدام التطبيق بالحصول على هذه البيانات الشخصية واستخدامها ومشاركتها، وفقًا لسياسة الخصوصية، على النحو المنصوص عليه في الرابط أعلاه.

توافق على عدم القيام بأي مما يلي: (أ) إجراء هندسة عكسية للتطبيق أو أي جزء منه أو فكه أو تفكيكه أو ترجمته أو تعديله أو تبديله أو تغييره بأي طريقة أخرى؛ (ب) محاولة اشتقاق شفرة المصدر أو مكتبة الصوت أو بنية التطبيق دون الحصول على موافقة كتابية صريحة مسبقة من Telenav؛ (ج) الإزالة من التطبيق أو تغيير أي من العلامات التجارية أو الأسماء التجارية أو الشعارات أو إشعارات براءات الاختراع أو حقوق النشر الخاصة بشركة Telenav أو مورديها أو غيرها من الإشعارات أو العلامات؛ (د) توزيع التطبيق أو ترخيصه من الباطن أو نقله بأي طريقة أخرى إلى الآخرين، باستثناء جزء من النقل الدائم للتطبيق؛ (هـ) استخدام التطبيق أو الوصول إليه بأي طريقة: (١) تنتهك حقوق الملكية الفكرية أو حقوق الملكية أو حقوق الدعاية أو الخصوصية أو الحقوق الأخرى لأي طرف، (٢) تنتهك أي قانون أو تشريع أو مرسوم أو لائحة، بما في ذلك على سبيل المثال لا الحصر القوانين واللوائح المتعلقة بالبريد العشوائي والخصوصية وحماية المستهلك والأطفال والفحش أو التشهير وجميع القوانين واللوائح المعمول بها لمراقبة التصدير وإعادة التصدير، (٣) ضارة أو مهددة أو مسيئة أو مضايقة أو ملتوية أو تشهيرية أو مبتذلة أو فاحشة أو مرفوضة بأي شكل آخر؛ (و) إيجار أو تأجير أو السماح بطريقة أخرى بالوصول غير المصرح به من قبل جهات خارجية إلى التطبيق دون إذن كتابي مسبق من Telenav.
على الرغم من أننا نسعى جاهدين لتوفير معلومات دقيقة عن الطقس، لا يمكننا ضمان دقة معلومات تطبيقنا أو اكتمالها أو توقيتها أو موثوقيتها. تقر وتوافق على أن أي اعتماد على هذه المعلومات يكون على مسؤوليتك الخاصة.
باستثناء الحالات التي يحظرها القانون المعمول به، لن تتحمل Telenav أو مرخصوها أو عملاؤها أو موردوها أو وكلائها أو موظفوها بأي حال من الأحوال المسؤولية عن أي قرار أو إجراء تتخذه أنت أو أي شخص آخر بالاعتماد على المعلومات التي يقدمها التطبيق. إن Telenav والمرخصين والعملاء والموردين التابعين لها لا يضمنون أو يشترطون دقة البيانات المستخدمة في التطبيق ما لم ينص على خلاف ذلك بموجب القوانين المعمول بها. لا تضمن Telenav ومرخصيها وعملائها ومورديها أيضًا أن استخدامك للتطبيق سيكون دون انقطاع أو بدون أخطاء. ستبذل Telenav جهودًا معقولة للحد من مثل هذه الأحداث أو منعها، ولكن لن تكون Telenav مسؤولة بأي حال من الأحوال عن أي أضرار مالية أو أضرار أخرى بسبب هذه الانقطاعات. تتحمل المسؤولية عن كامل المخاطر الناشئة عن استخدام التطبيق.

تخضع هذه الاتفاقية والأداء بموجب هذه الاتفاقية ويتم تفسيرهما وفقًا لقوانين ألمانيا، دون تفعيل تعارضها مع أحكام القوانين. إلى الحد الذي يكون فيه الإجراء القضائي ضروريًا فيما يتعلق بالتحكيم الملزم، توافق أنت وTelenav على الخضوع للاختصاص القضائي الحصري لمحاكم برلين بألمانيا. لا تنطبق اتفاقية الأمم المتحدة بشأن عقود البيع الدولي للبضائع.
لا يجوز لك إعادة بيع هذه الاتفاقية أو أي من حقوقك أو التزاماتك أو التنازل عنها أو نقلها، إلا في مجملها، فيما يتعلق بنقلك الدائم للتطبيق، وشروطًا صريحًا بموافقة المستخدم الجديد للتطبيق على الالتزام بشروط وأحكام هذه الاتفاقية. أي بيع أو تنازل أو نقل غير مسموح به صراحة بموجب هذه الفقرة سيؤدي إلى الإنهاء الفوري لهذه الاتفاقية، دون مسؤولية تجاه Telenav، وفي هذه الحالة يجب عليك أنت وجميع الأطراف الأخرى التوقف فورًا عن استخدام التطبيق. بالرغم مما سبق ذكره، يجوز لشركة Telenav التنازل عن هذه الاتفاقية إلى أي طرف آخر في أي وقت دون إشعار، بشرط أن يظل المتنازل له ملزمًا بهذه الاتفاقية.
٨٫١ تشكل هذه الاتفاقية مجمل الاتفاقية بينك وبين Telenav فيما يتعلق بالموضوع المذكور هنا.
٨٫٢ باستثناء التراخيص المحدودة الممنوحة صراحةً في هذه الاتفاقية، تحتفظ Telenav بجميع الحقوق والملكية والمصلحة في التطبيق، بما في ذلك على سبيل المثال لا الحصر جميع حقوق الملكية الفكرية ذات الصلة. لا يُقصد من أي تراخيص أو حقوق أخرى غير ممنوحة صراحة في هذه الاتفاقية منحها أو منحها ضمنيًا أو تشريعًا أو تحفيزًا أو منعًا أو غير ذلك، وتحتفظ Telenav وموردوها ومرخصوها بموجب هذا بجميع حقوقهم الخاصة بخلاف التراخيص الممنوحة صراحةً في هذه الاتفاقية.
٨٫٣ باستخدام التطبيق، فإنك توافق على تلقي جميع الاتصالات من Telenav، بما في ذلك الإشعارات والاتفاقيات وعمليات الكشف المطلوبة قانونًا أو المعلومات الأخرى المتعلقة بالتطبيق (يشار إليها إجمالاً باسم "الإشعارات") إلكترونيًا. قد توفر Telenav مثل هذه الإشعارات عن طريق نشرها على موقع Telenav على الويب أو على التطبيق أو عن طريق تنزيل هذه الإشعارات على جهازك. إذا كنت ترغب في سحب موافقتك على تلقي الإشعارات إلكترونيًا، فيجب عليك التوقف عن استخدام التطبيق.
٨٫٤ لا يؤثر فشل Telenav أو فشلك في طلب أداء أي حكم على حق هذا الطرف في طلب الأداء في أي وقت بعد ذلك، ولا يشكل التنازل عن أي خرق أو تقصير في هذه الاتفاقية تنازلا عن أي خرق أو تقصير لاحق أو تنازل عن الحكم نفسه.
٨٫٥ إذا تم اعتبار أي حكم من أحكام هذه الاتفاقية غير قابل للتنفيذ، فسيتم تعديل هذا الحكم ليعكس نية الأطراف، وستظل الأحكام المتبقية من هذه الاتفاقية سارية المفعول والتأثير الكامل.
٨٫٦ العناوين الواردة في هذه الاتفاقية هي لتيسير الرجوع إليها فقط، ولن يتم اعتبارها جزءًا من هذه الاتفاقية، ولن يتم الرجوع إليها فيما يتعلق ببناء أو تفسير هذه الاتفاقية. على النحو المستخدم في هذه الاتفاقية، لن يتم اعتبار الكلمات "تتضمن" و"بما في ذلك" وأشكالها المختلفة شروطًا للتقييد، ولكن بدلاً من ذلك سيتم اعتبارها متبوعة بعبارة "على سبيل المثال لا الحصر".
